Living above a Jackass...

I live in sort of like a townhouse type thing, where there are 5 units. Mine, is all one floor, and happens to be the top floor of the building. I have a stairwell that goes down through the guys house below me. Anyways, this guy who lives downstairs is a real jackass. If someone at my house is watching TV, even about as loud as a normal person talks, he bangs on the bottom of the stairs because we are too loud. When my girlfriend is walking outside to get to the car, sometimes he makes rude comments to her about stupid stuff like "Some people work all night, KEEP THE NOISE DOWN!"

Now for the funny part. Until yesterday I had not witnessed any of this. The guy knows my work schedule or something, because I have heard from my girlfriend and her sister about how much of a dick this guy really is, and was sceptical because it was odd I had not seen anything abnormal going on. (Keep in mind I have lived here over a year, and so has he)

On friday my Jeep overheated and I had to get it towed home, so I guess me not driving it, and it getting towed home threw him off, because I was driving the girlfriends car. So last night about 5-6ish, I was sitting upstairs trying to watch the news. I could hear he was playing some music, and it slowly became a little louder and louder... so Finally it got to the point where I couldn't hear my own tv, about 10 feet away, pictures where rattling. I went downstairs, had to ring his doorbell about 5-6 times as he couldn't hear it, then when he finally came to the door, I asked if he could turn it down because I couldn't hear the tv... his responce was...

"It's 5 o'clock in the afternoon, shut up"
I went back upstairs and called the building owner to complain..

That is my rant, what would you guys do?

I have been thinking about calling the by-laws officer on him and complaining, because he has two junk and un-insured (leaking fluid cars) cars sitting in the back alley where we all park. Oh yes, should mention he is about 120lbs, and his voice is not much different from his wifes... and hes a Cook.. haha so him physically intimidating me, is out of the question.

he used to come down and swear and scream at me and threaten me whenever i listened to music or watched my tv at a reasonable volume. this went on for months, all the while he kept phoning and writing letters to the landlord, making fake accusations that i smoke in the house, tamper with the hot-water, have crazy parties all night, and am way too loud. he would write letters 3 pages long with a bunch of complaints about things i didnt do. i suspect he is mentally ill as well, and hes also a rent a cop, which is probably why he is always accusing me of things. hes one creepy old man. the ****in guy sure had some mean insults. he once told me the african refugees who used to live in the house through their church group, were starting to look like better tenants than me. what a freakin jerk. then i had to write a bunch of letters to the landlord saying that i dont tamper with the hot water, i dont smoke, and whole host of other fake accusations. the hot water thing was ridiculous the reason your water isnt hot is because its december! the landlord turned up the water temperature, then 2 weeks later he started complaining that the water was too hot!
eventually the landlord issued him a written warning that if he ever talks to me again, he has 10 days to get his stupid old fat useless ass out of the house.
no matter what nobody is going to be happy in a house where 2 different parties rent the same space. youre just gonna have to learn to live with it.

me and my buddy kevin had a crappy neighbor once, always gave us crap for having people over all night even though there was no way he could hear anything from our house, I think he was just mad he had no visitors :laugh

I understand what it is like to rent in buildings like this. But what I am getting at is the guy complains about everyone making nose and so on, and then he blasts his music so loud that I cannot talk to someone unless they are right beside me.

I do NOT have parties at my house, I do NOT make lots of noise, and there are 3 other units in the building beaides me and him, and they ALSO hate this guy.

What I am getting at is that we did nothing wrong, asked him to turn it down so we could live peacefully, and he got all pissy and slammed the door.

I concider that to be a completly un-reasonable responce.

well if everyone else there doesnt like him and wants to get together and tell the landlord about how he keeps harrassing you guys, then he could be asked to leave or to stop bothering everyone else. read your tenancy agreement very carefully and see how it works there, and see how you can get this guy off your case.
whenever he does something like that, you should write down when it happened. keep track of how many times, and when he does stupid things like that. if you decide to go to your landlord, he/she is going to want something in writing, and if you havent been keeping track on paper you dont have jack to use against him.

i cant wait till i own my own property, then when grumpy old people tell me my tv is too loud i can tell them to take a hike!

haha, well I appreciate everyones responce.. I will get this jackass evicted one way or another... tomorrow I am calling the by-laws enforcement about his broken down and Un-Insured cars.(and one of them leaks powersteering fluid all over the ground)

If you can't do anything the leagal route, try this:

1. Go find yourself cut up squid or the like entrails that people use to bait their crab traps with.

2. Place said entrails in plastic bucket, cover with water

3. Leave bucket in direct sunlight for approx. 1-2 weeks

4. Put on respirator mask and open lid, scooping a large cup of this foul-smelling concoction

5. Pour said mixture into his remaining operating motor vehicle's heater cowling.

6. Watch his 2 parked cars quickly become 3!!!!:laugh :laugh

Record everything that happens. Time, date, duration. Make notes. Make tape recordings if possible.
This will come to a head if you are planning on staying there. IF you have mucho back-up, and he has none, who is going to look like a crackpot?
Try to talk to him, and hope he threatens you. You then have legal recourse to apply for a peace bond.
Either that or take him off roading and get him to "spot" you as you crawl up a rock. Oops, couldn't see him, he must have slipped.

Read the RTA that someone posted up for you.
Section 28 outlines your right to quiet enjoyment of the space you live in.
Go get a copy of the act from a Tenency office, highlight section 28 and tape it to his door.
He may even believe it is from your landlord.
Get your neighbours together and write a letter to your landlord.
Include the section on quiet enjoyment.
Explain your rights.
If the landlord does not comply and at least go talk to the guy, file a complaint with the Residencial Tennancy Office.
You are entitled to the arbitration process.
This will get your Landlords attention...one way or the other.

Look up your Charter of Right's.
This also protects all of us from harrasment.
Tape this to his door as well.
If it persists I agree that involving local police may be necessary.

Bullies tend to be the weakest people out there.
He clearly thinks he has a right to treat people this way.
Call him on it.

You can always beat the crap out of him later, but that may bring consequences you don't want either.

I used to get noise complaints from running my bathroom tap at 9pm at night becuase it was too loud..


I ending up moving out a month or two after I kept hearing banging on the floor for normally opening and shutting cupboard doors around lunch time...

it got really bad.. I was at the point there I tip toed around the house 24/7 for the last month I was there cuase my landlord couldn't sleep cuase they were calling him all hours of the night with other complaints aswellas me brushing my teeth before bed.
